Dozens of patients who were accidentally treated with tainted surgical instruments at Duke University Health System hospitals in 2004 filed a civil suit Tuesday in Durham against the companies contracted by the University to sterilize the equipment.
In November and December 2004, DUHS physicians operated on more than 3,600 patients using instruments mistakenly cleaned with hydraulic fluid. The fluid was drained from an elevator and unintentionally sent to Durham Regional Hospital and Duke Health Raleigh Hospital for use as detergent.
The 67 plaintiffs-a group composed of patients and their spouses-accused medical supply companies Cardinal Health 200 and Steris Corporation of corporate negligence, unfair and deceptive trade practices and obstruction of justice in concert with DUHS, according to the suit. Cardinal Health sold the University the cleaning materials manufactured by Steris Corp. in 2004.
A representative of Cardinal Health declined to comment, citing company policy, and Steris Corp. officials could not be reached for comment.
The University settled out of court with an undisclosed number of patients exposed to the hydraulic fluid for an undisclosed amount in April, ABC Eyewitness News reported. Terms of the settlement have been kept confidential.
The patients filing the suit seek more than $30,000 each from the companies in compensatory, punitive and treble damages, according to the suit. Additionally, the plaintiff spouses are entitled to $10,000 in damages, lawyers wrote in the suit.
DUHS sent patients a letter in December 2004 stating that the risks of exposure to hydraulic fluid were minimal and emphasizing that the tainted instruments were subsequently sterilized as part of the standard cleaning process prior to the operations.
Patients exposed to the hydraulic fluid have reported health problems including debilitating infections, rapid weight loss and skin rashes. An independent study conducted in July 2005 found cancer-causing particles and metals in the hydraulic fluid.
In 2007, however, a University-commissioned study by PharmaLinkFHI-a Durham-based private health research firm-found that almost 90 percent of the affected patients did not suffer any serious clinical problems.

Cardinal Health Inc. is consolidating two distribution centers in Alabama to streamline and modernize operations in the state.
Dublin-based Cardinal is closing its 123,000-square-foot distribution center in Bessemer and shifting its employees and medical product distribution operations to its 270,000-square-foot facility in Birmingham, about 15 miles away. The Bessemer operation employs 100 workers, all of whom have volunteered to transfer to the Birmingham center, according to a filing with the state.
The company's lease on the Bessemer building is to expire late this year. The move is expected to occur in the fall, the company said.
Cardinal spokesman Troy Kirkpatrick said employees at the combined facility will be retrained for what will become a medical products distribution center for hospitals and outpatient clinics. The Birmingham center was a general merchandise distribution outlet whose operations are moving to another Cardinal distribution center, Kirkpatrick said.
We continue to review our network of distribution centers and it made sense to streamline our operations in Birmingham, Kirkpatrick said. It made sense to consolidate into the Birmingham facility because it is bigger and more modern than the Bessemer facility.
Cardinal (NYSE:CAH) runs about 280 domestic facilities, about 50 of which are medical-surgical distribution and assembly centers
Cardinal, the largest publicly held company in Ohio, recorded a $1.9 billion profit on $86.9 billion in revenue in its fiscal 2007. It employs more than 43,000 workers worldwide, including 2,700 in Central Ohio.

DUBLIN, Ohio (AP) - Cardinal Health Inc. said Thursday its fiscal third-quarter profit soared from a year-ago period in which the health care products and services company established a $600 million reserve to settle lawsuits alleging securities law violations.
For the quarter ended March 31, net income rose to $356 million, or $1.02 per share, from $19 million, or 5 cents a share, a year ago. Excluding one-time charges, profit totaled $1.08 per share in the latest period.
Revenue rose 5 percent to $22.91 billion from $21.87 billion.
Analysts surveyed by Thomson Financial expected adjusted earnings of $1.01 per share on higher revenue of $23.42 billion.
In the 2007 quarter, the company established a reserve to settle lawsuits brought by investors which accused Cardinal and its officers of violating securities law by manipulating accounting practices and inflating Cardinal's earnings. Federal regulators began investigating the company in October 2003 over its accounting of money it got from vitamin manufacturers. The investigation was expanded to include its core pharmaceutical distribution business.
Cardinal then began an internal investigation, which resulted in the company restating its annual and quarterly financial statements for three years. Some employees were disciplined or fired, and the company's chief financial officer quit in 2004.
In its main wholesale drug distribution business, Cardinal said revenue rose 3 percent in the latest quarter to $19.9 billion but profit fell 31 percent to $300 million.
Cardinal said that business has been hurt by contracts with large customers being renegotiated at lower levels. It also cited the expense of measures it is putting in place at its distribution centers after three centers were cited by the federal government for not having effective controls on drugs. In one case, a distribution center in Florida supplied a painkiller to a business accused of dispensing excessive amounts based on illegitimate prescriptions from Internet pharmacies.
Cardinal, based in suburban Columbus, reaffirmed its earnings outlook for the year of $3.75 to $3.85 per share, excluding one-time items. Wall Street is looking for profit of $3.78.

In choosing recipients, Cardinal Health looked for projects that respond to a clearly identified, high priority safety issue; collaborative programs; projects that apply new thinking and approaches to development of solutions; model programs that can be replicated at other organizations and demonstrable and sustainable measures to ensure that improvements last over time.
